Appeals Court Upholds Decision Against Internet Archive’s Book Scanning Program

The Second Circuit Court of Appeals unanimously affirmed a March 2023 lower court decision finding the Internet Archive’s program to scan and lend print library books is copyright infringement. “This appeal presents the following question: Is it ‘fair use’ for a nonprofit organization to scan copyright-protected print books in their entirety, and distribute those digital copies online, in full, for free, subject to a one-to-one owned-to-loaned ratio between its print copies and the digital copies it makes available at any given time, all without authorization from the copyright-holding publishers or authors? Applying the relevant provisions of the Copyright Act as well as binding Supreme Court and Second Circuit precedent, we conclude the answer is no,” the decision states.

California Passes Freedom to Read Act to Curtail Book Bans

HT @veronikellymars Joining several other states that have passed anti-book ban acts in the last two years–Illinois, Colorado, Maryland, Minnesota, Vermont, and Washington–the California legislature has officially signed off on a bill to curtail book bans across the state. It enshrines the importance of libraries to democracy with a bill that aims to end book bans, retaliation of library workers, and protecting library materials.

Penguin Random House, 5 Additional Publishers, & Authors Guild File Landmark Lawsuit Against State of FL for Unconstitutional Book-Banning Provisions

Penguin Random House, Hachette Book Group, HarperCollins Publishers, Macmillan Publishers, Simon & Schuster, and Sourcebooks have filed a lawsuit against FL public officials, challenging sweeping book removal provisions of HB 1069, an education law that restricts books in school libraries. The additional plaintiffs joining the publishers are the Authors Guild, bestselling authors Julia Alvarez, Laurie Halse Anderson, John Green, Jodi Picoult, and Angie Thomas, two students, and two parents. As a result of HB 1069, hundreds of titles have been banned across the state since the bill went into effect in July 2023. The list of banned books includes classics such as Brave New World by Aldous Huxley, A Tale of Two Cities by Charles Dickens, For Whom the Bell Tolls by Ernest Hemingway, and The Adventures of Tom Sawyer by Mark Twain, as well as contemporary novels by bestselling authors such as Margaret Atwood, Judy Blume, and Stephen King. Among nonfiction titles, accounts of the Holocaust such as The Diary of a Young Girl by Anne Frank have been removed. #teamPRH
