AI: Publishers Warn White House of ‘a Bloated Fair-Use Defense’ and an ‘Unworkable Opt-Out Regime’
HT @BISG
Book Biz to Big Tech: Pay Up, Then We Can Make Up
The Association of American Publishers (AAP) and the Association of University Presses (AUP) delivered responses to the White House Office of Science and Technology Policy’s request for public comment regarding the development of the administration’s Artificial Intelligence Action Plan. The AAP emphasized the critical role of copyright protections in maintaining American leadership in AI markets. It noted that American publishers generate nearly $30 billion annually in the U.S. alone and are part of a broader coalition of industries built on intellectual property that add more than $2.09 trillion in annual value to gross domestic product. For its part, OpenAI and others lobbied the Trump administration to essentially deregulate the industry by eliminating all guardrails—including, potentially, any responsibility to respect copyright.

HT @publishingtrend Spotify announced a new publishing program for authors that allows them to submit short-form stories they’d like to see turned into audiobooks. When Spotify selects a story for audiobook publishing, it will handle the production and distribution of the work to other major audiobook retailers, the company said. Meanwhile, Spotify will pay the author both an advance and royalties.

People are using Google’s new AI model to remove watermarks from images
Following the expansion of Gemini 2.0 Flash’s image generation capabilities, the model can not only generate and edit images but also remove watermarks, often filling in gaps left behind, including those from major stock media companies like Getty Images. The lack of restrictions on its use has raised concerns among copyright holders, as removing watermarks without consent is deemed illegal under U.S. copyright law, except in rare cases. In contrast, other AI models, such as Anthropic’s Claude 3.7 Sonnet and OpenAI’s GPT-4o, explicitly refuse to facilitate watermark removal.
400 Hollywood Creatives Push Back on OpenAI and Google’s Calls to Train AI on Copyrighted Material
Major Hollywood figures, including Ron Howard and Cate Blanchett, are opposing OpenAI and Google’s requests to the U.S. government for access to copyrighted works for AI training, arguing that this could undermine the creative industries that provide millions of jobs and support democratic values. In a letter to the White House, they expressed concern that the tech giants are seeking special exemptions to exploit the arts without compensating creators, calling instead for appropriate licensing agreements. This pushback comes after OpenAI and Google suggested that strict copyright laws might hinder U.S. competitiveness in AI against countries like China.

The End of Programming as We Know It
Per @timoreilly: There’s a lot of chatter in the media that software developers will soon lose their jobs to AI. I don’t buy it. It is not the end of programming. It is the end of programming as we know it today. This is not new, as programming has changed many times before.

Wired is dropping paywalls for FOIA-based reporting. Others should follow
Wired is going to stop paywalling articles that are primarily based on public records obtained through the Freedom of Information Act. The FOIA process is time- and labor-intensive and reporters face stonewalling, baseless denials, lengthy appeals processes, and countless other obstacles and delays. Investigative reports based on public records are among the most expensive stories to produce and share with the public. The media needs to step up and invest in serving the public during these unprecedented times. And the public needs to return the favor and support quality journalism.
